As for anyone else who dreams of being licensed to privateer. Put down that bottle of rum and pipe down on the yohohoing. I know, I know, I'm a horrible punster, sorry about that but it is an addiction.

A Letter of Marque and Reprisal, as described in the older versions of the Constitution of these United States of America, had very definite limitations and strict legal regulations. You may not attack your own side, an Ally by Treaty or an acknowledged Neutral flag. The enemy you are permitted to fight and capture has to be an Enemy flag as per a Declaration of War by the United States Congress.

That is why, during the War of Northern Aggression, raiders licensed by the States of the Confederacy, eventually wound up being considered pirates, not privateers. Federal jurisdiction, Federal Constitutional Authority overrode State's Rights.

You might take the time if interested to look up/wiki historical examples of the difficulties and confusions that resulted in numerous legal entanglements and years of lawyer legal fees to sort out. For a simple example, your privateer seizes an enemy flagged vessel caring a lawfully neutral cargo? Or, You stop a vessel flagged as neutral but with a crew of suspicious origin and a cargo that a spy had informed you was contraband to be delivered to your enemy?
