It is cheating, by two spouses married to different people. Neither of the uninvolved parties know, even if one expressed a desire to never be told the truth. Any way you slice it, the other two, even the husband with the *theoretical* hall pass that he never checked on and does not plan to confirm, cheating on the person they gave their wedding vows to.
